Terms of service

1. Introduction
This Terms of Service agreement ("Agreement") is between the dog walker and pet sitter, referred to as the "Service Provider", and the client, referred to as the "Client". This Agreement outlines the terms and conditions under which the Service Provider will provide dog walking and pet sitting services to the Client's pets.


2. Reservation and Cancellation

The Client may reserve dog walking and pet sitting services by contacting the Service Provider through the specified channels.

The Service Provider reserves the right to cancel any service up to 24 hours prior to the scheduled date of service. In such cases, the Service Provider will provide an alternative arrangement. If Service Provider is not reasonably able to provide an alternative arrangement and the Client already paid the agreed upon fee, the Service Provider will either issue a refund to the Client or apply such amount as a credit for future services.

In the event of inclement weather or otherwise unsafe conditions, as determined by the Service Provider in its sole discretion, the Service Provider reserves the right to substitute a 30-minute walk with 30 minutes of indoor playtime to ensure the pet's safety and well-being. The Service Provider reserves the right to cancel scheduled services in the event Service Provider determines, in its sole discretion, that Service Provider cannot reasonably travel to the Client’s location due to inclement weather or otherwise unsafe conditions, in which case no fee shall be due to the Service Provider. 

The Client may cancel scheduled services without charge up to the day before the scheduled service date. If the Client cancels services the same day, but prior to the Service Provider departing for Client’s location, a 50% fee for services rendered will be charged to the Client. If the Client cancels services after the Service Provider has departed for Client’s location or fails to timely notify the Service Provider of a cancellation, 100% of the fee will be due.

3. Service Terms

The Service Provider will provide dog walking services, drop-in visits, and overnight stays at the Client’s or Service Provider’s location, as mutually agreed, for the Client's pet(s) according to the agreed schedule.  

The Service Provider will ensure that any necessary precautions, such as using proper leashes and harnesses, are taken during walks to ensure the pet's safety.

The Service Provider will take reasonable care of the Client's pet(s) during the time of service.

The Client is solely responsible for any damage and/or injury caused by the pet(s) to property or persons outside of the Service Provider's control and/or to the Service Provider’s location if staying overnight, and the Client hereby releases, indemnifies and agrees to hold harmless the Service Provider for any resulting claims, actions, costs, and expenses.

4. Payment and Fees

The Client agrees to pay the agreed upon fee for the services rendered by the Service Provider. 

Payment for the services is due prior to or by the end of the week of the scheduled service date.

The Client agrees to pay or reimburse the Service Provider for any additional costs and/or fees not expressly included with the services, such as emergency veterinary care and grooming appointments.

In the event that payment is not received within the agreed term, the Service Provider reserves the right to suspend or terminate services until the outstanding balance is settled.

5. Representations and Warranties

The Client represents and warrants that: (a) they own the pet(s); (b) the pet(s) is/are free from fleas, ticks and other pests; (c) they have disclosed to the Service Provider all material information about the pet(s) including medical conditions, dietary requirements and behavioral conditions; and (d) they have complied with all applicable laws, rules, regulations and ordinances with respect to the pet(s) including without limitation registration and vaccination requirements. 

6. Liability and Insurance

The Service Provider agrees to carry liability insurance to provide coverage for any damages or injuries that may occur due to the Service Provider’s gross negligence or willful misconduct during the provision of services, up to the policy limits.

The Client acknowledges that while the Service Provider will exercise reasonable care and professionalism in handling the pet(s), there are inherent risks involved, and the Service Provider cannot be held liable for any harm caused to the pet(s).

The Client shall be solely responsible for any claims, actions, costs or expenses (including without limitation veterinary bills and attorneys’ fees) caused by the pet(s) receiving services from the Service Provider. The Client agrees to release, indemnify and hold harmless the Service Provider for any such claims, actions, costs, and expenses.

7. Confidentiality and Privacy

The Service Provider will maintain the confidentiality of the Client's personal information and will not disclose it to any third parties without the Client's consent, except as required by law.

The Client agrees to provide accurate and up-to-date information regarding their pet(s) and emergency contact details to the Service Provider.

8. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the state of Tennessee in Davidson County.

Any disputes arising out of this Agreement shall be resolved by the courts of the state of Tennessee.

By engaging the services of the Service Provider, the Client agrees to abide by the terms and conditions outlined in this Agreement. The Client further acknowledges that they have read, understood, and agreed to the terms contained herein.
